EU-Kommission, Stellungnahme zu Artikel 6 Absatz 4 FFH-Richtlinie

Im Planfeststellungsverfahren zur A 44; Teilabschnitt Hessisch-Lichtenau hat die Europäische Kommission, Generaldirektion Umwelt, in einer Stellungnahme vom 23. Juli 2007 ausdrücklich festgestellt, dass Artikel 6 Absatz 4 der Richtlinie 92/43/EWG vom 21. Mai 1992, der eine Stellungnahme der Kommission vorsieht, nur dann Anwendung findet, wenn in dem Gebiet von gemeinschaftlicher Bedeutung prioritäre Arten oder Lebensräume vorkommen und diese durch das Vorhaben oder den Plan in Mitleidenschaft gezogen werden.
